Loss of Capacity: Planning for it.
Question: My husband is slowly succumbing to Alzheimer's Disease. He has good and bad days but it is getting worse and I need to be able to make decisions in the future for our financial well-being as well as his health care decisions. What are my options?
Answer: If your husband is competent to execute a Durable Power of Attorney and a Durable Power of Attorney for Health Care, he should. The Durable Power of Attorney would allow him to name you, or another agent, as an attorney-in-fact, to make financial decisions for him should he become incompetent. The Durable Power of Attorney for Health Care would serve the same function as it relates to health care decisions. By planning for incompetency now, he can avoid putting you through the process of setting up a guardianship so that you can administer to his and your financial and health care needs.
