I Changed My Mind - Revoking Your Durable Power of Attorney to Name Another Agent

Circumstances change and things happen. People change their minds. Individuals can revoke their Durable Powers of Attorney at any time. If you should want to do this, it is important that you take certain steps to protect yourself.

First, execute a new Durable Power of Attorney and be sure to reference the document you seek to revoke and the date of the document. Sometimes, if you believe that there might be a future issue with the revocation and the change(s) that you make, state the reasons for the decisions in your new document.

Second, destroy the physical original and any copies of the old document and notify your former agent that you are revoking the original Durable Power of Attorney and would like document returned or destroyed. You may also need to record the Revocation in the County Auditor's office.

Third, notify your new agent and give them, as well as any agencies that need it, a copy of the new Durable Power Attorney for their records. Indicate to your new agent at that time, where the original document is kept so that they have access to it if it should become necessary.
